Actually, with the facts I see, this is a very winnable case. Remember in civil court the standards for guilt are not the same as criminal court. Nicole was
diagnosed with an avulsion fracture of the cuboid bone in her right foot. A case can easily be made, that it would have been near impossible for her to run the distance she did, at the pace she ran for so long, if she entered the race with this injury. The video shows her falling, then her stride and pace were completely different. An expert can testify as to the additional force on the foot an extra 3" will make when landing - then multiply that by the number of laps. Also, Doug Logan, the chief executive officer for USA Track and Field, told The Associated Press he took responsibility for the mistake and sought out Bush to apologize and offer assistance for medical treatment and rehabilitation - a great gesture, however, in civil court, the actions show a preponderance for guilt.
This is why their would be a settlement out of court.
If not, I would love to be the prosecuting attorney...and it would be great if "wondering if it true" would be the defense attorney
