Because he's smart enough to stay in the Bahamas. At this stage there would be an arrest only if he confessed, but I bet the Justice Department is on the case. It's very doubtful that he will be a future donor, so why wouldn't he be arrested regardless of which party he donated to. And he and his co-founders donated pretty equally to both parties.

As someone noted, at this point there will only be an arrest if he confessed--the evidence has to be gathered. Madoff at least was honorable enough to confess once the jig was up.
At this point, his defense is obviously that he was just stupid and so it wasn't fraud (which requires intent). If his girlfriend really is turning that aint gonna work.
This. There is almost no oversight. That said most likely some people are going to go to jail over this. It is just going to take a long time. Cases can last 4-5 years. How long was it for Elizabeth Holms?

SBF played both sides of the aisle with his political contributions. He publicly gave to Dems (but supported centrist dems like Henry Cuellar over insurgent Bernie aligned leftist Jessica Cisneros) because that fit with his profile of being a do gooder with his "effective altruism" bs. But behind the scenes, he gave equal amounts to Republicans through dark money donations because his ultimate goal was to prevent crypto regulation.
As noted above, crypto does not fall under either the SEC or Commodities Future Trading Commission. At best, the FTC would have jurisdiction to the extent there was advertising or sales practices that violated the FTC Act's broad prohibitions on deceptive trade practices. But the FTC rarely makes criminal referrals. So, it is pretty much just the FBI and state criminal enforcement to find evidence of criminal fraud, embezzlement, etc. And it is not a crime to be bad at business and run a business into the ground. And to make matters more difficult, SBF ran his business from the Bahamas. So, getting a warrant to search his business and seize records would depend on cooperation from Bahamian officials. That just means things will move very slowly.
Ultimately, I think SBF get indicted because the main reason FTX went under was because SBF concocted a scheme to siphon funds out of FTX in exchange for worthless tokens so he could basically gamble with those funds at Alameda Research, his hedge fund.
billions of dollars that did not belong to ftx were moved to an entirely separate trading entity to cover huge losses without customer knowledge or consent. that is a crime. does not matter if crypto is per se not a security. The doj doesn’t care about location of fraud if Americans are victimized.
