In the interest of fairness to women, I do agree with Fina's ruling. I do not agree with the previous events which the NCAA did nothing about. It's an ideological construct.

I don't think a lawsuit would succeed unless they tried to apply the rules retroactively and start stripping titles and such won when the rules were not in place. For example, trying to vacate Thomas' NCAA titles would be an example of a lawsuit that FINA would lose.
There's nothing they can do if the rules are applied forward only unless it impacts athletes who were guaranteed a spot at certain future meets.

On the contrary I was planning on my 7 year old son competing in swimming, going trans, and toppling Lia Thomas' records. Now with this new rule change we will need to plan to transition him around 11 years 10 months to be sure we get in under the deadline.

As for the lawsuit, the panel included legal experts in addition to medical and sports experts. So they certainly considered that possibility.
A good thing about swimming is that most of top level swimmers start at very early ages. So you have the pre and post times to compare in determining the advantage of male puberty. Other sports may not have that luxury.
