Help me out here running legal beagles. Do you need to wear a mask while running on Federal property like a national park, or even the Washington mall? Or may running be considered a "celebration" and therefore qualify for the POTUS mask exception? I read the EO that reportedly mandates masks on Federal property, and as I read the EO, it does not make such a mandate. Two key provisions from the EO if you can read through all the extraneous BS:
1. "[I]ndividuals in Federal buildings and on Federal lands should all wear masks." "Should" is an advisory word, not a mandate such as "shall".
2. "Agencies shall . . . require compliance with CDC guidelines with respect to wearing masks." OK, here's a mandate to follow guidelines, which aren't a mandate. The CDC mask guidelines state in part: "Masks may not be necessary when you are outside by yourself away from others, or with other people who live in your household. "
So, if you run by yourself on Federal property you do not need a mask?
Will the National Guard fall out of the parking garage and force you off Federal land if you run without a mask?
