This is incorrect. There are only certain situations where that is required, this is not one of them. Actual malice is the legal standard when a public official/figure sues news media. Actual malice is not required for private people, but, if it is proven, is the standard for punitive damages. The OP is a private person and so proving actual malice is not needed.
