Ultimately they determine what they believe an asset is worth based upon their own methods and procedures. That is why the bank felt like they weren’t a victim (given that the loans were repaid with interest and finance charges). The civil fraud case should never have been brought (and there is no comparable case in the history of New York). It would never have been brought were Trump still a Democrat.
