International law dictates that we can't just turn back asylum seekers, so we have to process them. The bill would have ended "catch and release", where asylum seekers are just given a court date and released into the country.
By my reading, the bill actually would have broken international law in order to appease Republicans, because if there were more than 8500 border encounters in a single day, or an average of 5000/day for a week (keep in mind these are encounters, not people being let into the country), they would stop letting anyone in, regardless of if they were seeking asylum or not. And the 5000 people wouldn't be released, they'd be detained, processed, and deported if they didn't qualify as asylum seekers.
