Are you hung up on terminology? This has been a surveillance state since at least the PATRIOT act. How else can one describe a state of affairs where your privacy can be invaded remotely, preemptively, and/or without warrant? Perhaps it only becomes a ‘surveillance state’ when there are cameras on every corner or in your house? I guess the no-warrant surveillance folks found a way to have people install their own cameras. Trust them not to watch at your own risk.
Its actually quite amazing. We haven't had a major terrorist attack on US soil since 9/11. And that's due to the impressive accuracy of the intelligence industry's ability to profile and target dangerous actors with advanced pattern recognition and statistical models.
