1) On the one hand, perhaps surprisingly (but clearly in a good way), in the Trump era, the legal system does, indeed, seem to be proving itself much "better" than politics, and public opinion, and perhaps even "democracy."

That's not the only reason why Trump CAN'T take the stand. He's a HUGE fool though and very well might. IF Trump takes the stand, then anything and everything that goes to his character is fair game that wouldn't be otherwise. The prosecutors have warned Trump's lawyers with a "Sandoval Notice" that he will be cross examined, bringing up all of his fraud and other outstanding criminal charges, so this jury will hear about those things explained in detail by excellent prosecutors.

The Supreme Court is the X factor. The gift that was given to Trump by hearing his insane immunity claim and dragging their feet in urgency certainly appears to be political. We will see. My guess is that they will send it back to the lower court to determine if any of Trumps BS acts could be construed as “official”. This would be another gift to Trump wrapped with a bow and a cake.
