It may have been a crime to cross the border illegally, but even if you do, you are allowed BY LAW to request asylum and if you do, you are LEGALLY ALLOWED to stay until your hearing.

Trump has massively overperformed his polling in the last two elections. Biden had a larger polling lead than Hilary and barely scraped by with a win.
