I'd expand this to include a fourth question the jury will need to evaluate:
1) Did Cohen make payments to these women right before the election to keep them quiet?
2) Did Trump reimburse Cohen for these payments?
3) Did Trump have the records falsified to obscure the actual reason for the payments?
4) Was this, beyond reasonable doubt, done to influence the outcome of the 2016 presidential election in violation of federal election law?
The paper trail and witness testimony give a compelling affirmative answer to the first three, but this establishes misdemeanor falsification of business records only. It's the fourth question that establishes a felony and is the most reasonable basis of rejecting a felony conviction.

Plus, Trump could have simply paid Cohen in full and documented it as payment for NDA. Fearing that would violate campaign finance laws, the amount was instead grossed up as salary payments over time.
