2) Trump's lawyers could have challenged that and it would have been a basis for litigation and a possible appeal if they lost.
3) Trump's lawyers failed to ask for a jury trial (they couldn't check a box on a form!), so the case was a bench trial, as the law would stipulate.
4) The judge absolutely did NOT "set up" the trial "so there could be no jury."
