Either
1. Somebody upstairs had it in for Kearney and used this as an excuse to get her
2. The affair was not as consensual as Kearney would have us believe.
3. The student whom she was screwing has found God and needs to make someone pay for all of those satanic feelings she 'used' to have.
4. This was not a one-time deal and somebody running for her now dropped a dime on her. To minimize PR damage, UT and Kearney, rather than admitting that this has been a pattern, concocted this (true) story about how she was doing some student but a very long time ago.
5. Something even more byzantine and sinister.

Lets simply this , its a lawsuit , minimize the damages by showing no hesitation when the inappropriate behavior issue surfaces. Fear factor comes from possibility of NCAA sanctions to entire athletic department possibly hurting football the revenue generator.
Bev is paid out , gets to "resign" , university lawyers talk NCAA down , athlete gets paid out ( settles ) to drop lawsuit , back to business.
