A criminal proceeding in federal district court is a very different thing than a Senate impeachment trial. It's like oranges and fish.
If the DOJ charges Trump on the Marla-Ago documents purloin, obstruction and flood-destruction issues, it is very likely he will be convicted on the facts presented, including his own words. But that is a big IF. The DOJ has very difficult decision to make, and they can factor in the high potential for riots if Trump were to be busted in their charging decision. They have that discretion. Ultimate discretion. More discretion that J. Christ himself as he was beseeched on The Mount.

They have had multiple opportunities to do exactly that, but it appears that a court prohibition on knowingly making false or misleading statements and assertions, and a huge fear of being sanctioned for doing so, is holding those lawyers back.
