Question about "taking the 5th". Are you allowed (or should you be allowed) to take the fifth if the individual question has no bearing as to whether or not you have committed any crime?
No. That would be improper invocation of rights and subject a person to contempt sanctions.
And in the civil case Trump is in, I believe any answer invoking the Fifth, whether proper or not, will allow the judge to tell the jury that they can make an adverse inference against Trump on all the questions he refused to answer. Which makes sense - no innocent person pleads the Fifth. Only guilty people do.
And should you be allowed to say "same answer" rather than be keep repeating taking the 5th. I think having to repeat, "taking the 5th" drives home the point of someone refusing to answer because they fear criminality might be implicated.
"Same answer" is fine. It's clear what Trump was referring to. Trump was smart to use "same answer" because it prevent someone from making a highlight reel of him pleading the Fifth 400+ different times. He looks bad enough saying it once. Innocent people don't plead the Fifth. Ever.
If the opposing attorney is concerned about video or transcript optics, s/he could follow up with "When you say 'same answer,' do you mean you are refusing to answer this question because you believe the answer may incriminate you?" But that takes up time and probably isn't worth the extra effort on the client's dime. Trump looks fvcking terrible as the record stands, and setting him up for more easy b!tchslaps is unnecessary icing on the Bundt cake.
