The documents, compiled by the Trump Organization and obtained by the New York attorney general, show a previously unreported liability of $19.8 million listed as “L/P Daewoo.” The debt stems from an agreement Trump struck to share some of his licensing fees with Daewoo, a South Korean conglomerate that partnered with Trump on a project near the United Nations headquarters in New York City.

Biden doesn't work in the gray area. For example, he was told by the courts that extending the eviction moratorium was illegal without an act of congress, and he went ahead and did it anyway. (BTW, I also criticize Trump for starting this policy, but I don't think he would have continued it after the court told him to stop unlike Biden.) He was told by his Education Department that his student loan payoff was unconstitutional, but he did it anyway. He even set up a website to try to start the process of disbursing payments knowing it would get shut down. This is black-and-white. Furthermore, even if it were constitutional, it's ridiculous to even think a President should create trillion dollar programs without any act of congress, and totally contrary to our system of checks and balances. And Democrat leadership was pretty open about wanting to expand the court in order to get a majority to approve this stuff. Trump wanting to overturn the entire Constitution is MUCH worse, but it's also incoherent, and there's no mechanism to make it happen, and ironically Trump's own judicial nominees would prevent it, just like they ruled against many of his overreaches. Whereas the Democrat judicial appointees have reliably voted in favor of their executive power grabs.

On the eviction moratorium, biden says he was told it was close constitutionally. Which is pretty much the definition of a gray area. I think you are exaggerating how clear cut that was. From what I can tell, this is how the system is supposed to work. If there is a gray area, you rely on courts to make the final thumbs up and thumbs down. Which the Biden Admin did. Not a problem.
But sure, I'll say that congress should do this kind of work, not the exec branch.
