Guns are supposed to be checked by a prop master and another designated person on the set - i.e. thoroughly checked - before the actor ever touches the gun. There are so many guns in movies and TV, that's how it's been done for ages in the industry. Someone screwed up, and it wasn't the actor.
He pointed a loaded gun at two people and fired. He most definitely takes a large part of the blame for that alone. You never, ever do that. Even if it's "unloaded" or loaded with "blanks", because sometimes it can still have a live round or other complications...which he would have known if he actually checked his weapon. Negligent homicide is not a "Oops my bad, I didn't know so I'm not culpable."
Even that is a non-issue if they had the fore-sight to not film behind the camera or had a protective barrier in front of them. So they're fault as well. Also, whomever made all these unsafe decisions.
It's just as much his fault if not more his fault then the armourer, prop master, assistant director, or whomever was responsible for checking the firearm.
Now if it was purposefully sabotaged, and it can be proven...that's a different story.
