I’ve seen some legal scholars dispute that claim.
However, if Rivkin and the former president are correct, that means that Biden has “absolute immunity” from prosecution in just the same way, and it seems that there is a very broad reading of “within the outer perimeter” that should enable Biden to engage in a number of unlawful acts that you and I would consider overturning the rightful results of an election in 2024.
I’m not sure why any Trump supporters or other Republicans would want them to be making that argument.
