After this article was published, it elicited a lunchtime discussion at the law firm where I work. After I pointed out to my colleagues that it was referenced on LR, the discussion got more interesting. There have been many LR posts speculating about the legal issues surrounding this case. To help correct the inaccuracies here, I will lay out how a court would actually view this.
Libel involves an untruth that is published which will do harm to a person or their reputation by tending to bring the target into ridicule, hatred, scorn or contempt of others.
There are a few key issues here. First, an online forum is not a court of law. Anonymous posts and accusations would never be admissible. Those that have posted anonymously are easily identifiable with technology and held accountable in court, as was done in the cited case.
Next, accusations that may appear unquestionably true online, are not viewed the same by the court. In this case, the accused has not presented any kind of defense yet. However remote the odds may seem, if there are logical explanations for the accusations, these "truths" may not hold, making it easier to qualify as libelous. From accounts of what harm has occurred in the accused life it also fits the definition of libel.
There are many variables unknown, but It will certainly be interesting to see how this case plays out.
Why would they pull my post just because I mentioned a date with Kip's estranged wife? Does that mean they will pull pics from our date? It hardly seems reasonable.

Don't know anything about Kurt but I worked with Kent Litton in the mid 90's. He went by Ken & he looked just like his Facebook profile. One of my co-workers may have contact info on him- still working on it...
If Kent were real (and not just a made-up facebook page created just prior to its posting on this thread) you would be able to find info about him on-line. Kurt for sure is a brother of Kip's.

Sage Canaday placed a sentence mentioning Kip Litton in his new book about the Hansons Distance Project. Is Sage risking libel? I guess he took a chance but it's pretty obvious Kip doesn't have a leg to stand on. So I guess Sage the first one to talk about Kip in print and the only one so far. But not for long - the big article about Kip's coming....
The main websites about Kip are Writing About Running by Pat Price and the blog by SOKLR.

I remember reading that in the book recently, I thought it was awesome that Sage called him out.
Okay so I am a race director for a couple races and I think you would be surprised how many people cheat at races (even silly local 5k trots). It baffles me. But as race director when there is clear evidence that someone cheats I DQ them and move on. Did you get that? I move on. One more time I move on. Okay all together, move on.
