The fact that there are a small number of individuals whose sex is not easily determined in no way negates the notion that things would be fairer, especially to people born female, if we simply used sex at birth as the determinant to create two competitive divisions rather than the social construct, gender.
All high school kids have to get a physical to compete in school sports. As part of that physical by the child’s doctor, genitalia needs to be noted. If you possess a penis and testes, then you have to compete as a male - full stop.
No testing or requirements for suppression therapies or counseling. The athlete’s feelings do not matter. If d*** and b**** are present, then you only enter boys events. No more simple declarations about feeling like a woman to compete as one. A simple exam conducted by the medical professional as part of the existing sports physical.
We don't get upset that she competes with the women. We just get upset that she expects us to call her "they." And that she never feels like a man on race day.
Why does it matter what Nikki wants to be called or how Nikki feels on race day if Nikki is competing in the right biological sex category?

There are rarely simple solutions to complex problems. The complexity means other people who are also well-intentioned and smart disagree with you (and me) on this.
Transgender-Girls --- Some people have 100% male bodies but feel like they should "be girls." They don't have female hormones or anatomy but in many places around America the locals say, "you go girl!" and support that. In that community, they think it is awesome for people to find their truest selves.
DSD Girls --- Kids like Castor Semena are raised as girls and have some sort of biological or chromosomal abnormality. That makes it hard to tell what sex they are at birth. This usually doesn't help them athletically but sometimes it makes them nearly as strong/fast as men. I highly recommend the book Middlesex if you are the kind of person who likes literature.
Non-Binary People --- The ones who are female but don't feel like girls might choose to be "neither" and this is supported in many places around the country. They think it is key to being in a free country... you do you! These people, like Nikki Hiltz, still race in the biologically correct category even though they live their lives in the non-binary space.
Conservatives, please stop acting like these three groups are the same or that they don't exist. They have always existed. And because conservatives have been terrible on issues of minority and women's rights in the past, no one really trusts you when you say "we care about the women!" Most people don't trust your "feminist" motives.
Liberals, please stop acting like it doesn't matter and that everything is fine. Stop saying "but it is only a few of these people in each state and each level of the sport." If you have the right three or four people, you can beat all the women in the whole world.
So yes, even just a few people can completely reshape the whole world of women's sport. Ask at 800m runner from 10 years ago! There were only three DSD women in the sport and they went 1-2-3 in the Olympics!
That is why this issue is complex but the solutions are not simple.

What if they have no penis but they have fully functioning (internal) testes? What if they look exactly like a girl on the outside but have T-levels of a man?

I think it is simpler that you're making it out to be. Nikki Hiltz is a woman who competes with women. She identifies as they, but her birth sex is still XX female. So, that's that. If we go by this birth sex ruling, the majority of the world will compete by their birth sex, then we would have some outliers like Castor in a blue moon who need special testosterone testing. Let's protect women's and girl's sport for real. Competition by birth sex is an actual solution.
Of course the situation is more complicated. I am talking about high school sports because higher levels have rules and testing protocols regarding transgender athletes. High schools cannot afford testing but my proposal can be implemented at an existing point in the athlete eligibility process. Would a DSD individual or someone with internal testes make it undetected? Yes. But those people are extremely rare.
The Oregon issue is troubling because all one must do is declare themselves transgender and then compete as their preferred identity for the duration of the season. No evidence of counseling, hormone suppression, or gender affirming surgery required by the OSAA. What stops a second rate boys cross country team from declaring themselves women to win a state title? Nothing!
Sounds like people are asking for athletes to submit a birth certificate and documentation of a physical in order to compete.
I don’t want males competing against females either, but that sounds like an onerous process.
I’d be fine with an appeals process. Pick a gender and race as that. If a coach suspects a female competitor as being male, file a formal appeal. Then have the athlete supply the required documentation subject to disqualification.
It’s fine for people to say how they identify themselves as and how they wish to be viewed, as long as it doesn’t give them an unfair advantage in a sport which was designed to provide equity in the first place.

They should go back to testing for presence/absence of the SRY gene. Over 99% of the time, the SRY gene is on the Y chromosome, hence "male". Very rarely, translocations put it on an X chromosome, so an XX individual has an SRY gene and develops as a male, but that doesn't cause problems with athletics.
People without SRY genes should compete in the female category.
Trans girls/women have SRY genes, so should compete in the male category.
Caster Semenya has an SRY gene on her Y chromosome so should compete in the male category.
Nikki Hiltz does not have an SRY gene on either of their X chromosomes, so correctly competes in the female category.
There are very very rare instances where SRY gene testing might seem unfair, such as when an XY individual has CAIS (produces but can't respond at all to testosterone), so appears female. Such people should not compete in the female category. While possibly unfair to these rare CAIS people, the greater good (for 50% of the population that is female) calls for it.

This literally only was on one occurrence in the sport of track and field (Caster S.), and it was solved by a testosterone rule. Which should be a rule in all sports, if the case of dual genitalia occurs, so that way - again. We can protect women's sport.
